Two separate appeals by Donald Trump in his hush money case were dismissed on Thursday by New York's Court of Appeals. The former president sought to have a gag order lifted and his sentencing delayed, but both requests were denied.
The court issued a brief two-line judgment, stating that "no substantial constitutional question is directly involved." The gag order, initially imposed to prevent Trump from criticizing court staff, the jury, and the judge's family, remains in place.
Trump, the Republican presidential nominee, faced trial in New York City on 34 counts of falsifying business records. These charges were connected to hush money payments made to former adult film star Stormy Daniels. On May 30, a jury found Trump guilty on all counts, and Judge Juan Merchan is scheduled to sentence him on November 26.
The ruling read: "Appeal dismissed without costs, by the court sua sponte, upon the ground that no substantial constitutional question is directly involved." The phrase *sua sponte*, Latin for "of its own accord," indicates that the court dismissed the appeal without any request from prosecutors. Chief Judge Wilson and Judge Halligan did not participate in the ruling.
Trump's appeal to lift the gag order was previously rejected by the same court in June. During the trial, Judge Merchan found that Trump violated the gag order 10 times through social media posts and fined him $1,000 for each violation. Merchan also warned that, despite Trump being a former and potential future president, further violations could result in jail time.
Trump faced another setback on Thursday when the U.S. Second Circuit Court of Appeals rejected his request to delay his November 26 sentencing. Trump had argued for the case to be transferred to federal court, citing the Supreme Court’s ruling on presidential immunity. However, the court upheld a previous decision that the payments to Daniels were "private, unofficial acts" and not protected by executive immunity.
