Jack Smith Has One Final Card Up His Sleeve Against Donald Trump



Jack Smith may write a critical report on Donald Trump’s election-fraud case before stepping down, according to a former federal prosecutor.

Sahar Abi-Hassan, an assistant political science professor at Northeastern University in Oakland, California, told Newsweek that Special Counsel Smith is likely to complete his investigation, release a final report, and then resign. 

Trump faces four counts of allegedly attempting to illegally influence the results of the 2020 election, leading up to the January 6, 2021, Capitol riot. He has pleaded not guilty, asserting that the case is a politically motivated witch hunt and accusing Smith of interfering in the 2024 presidential election. The Trump campaign did not respond to *Newsweek*’s request for comment on Thursday.

Abi-Hassan noted that the Justice Department has a policy prohibiting the prosecution of sitting presidents, meaning that if Trump is re-elected in 2024, the case could be delayed until 2029. “I believe the most likely outcome is that Smith concludes his investigation, publishes a report, and resigns,” Abi-Hassan said. “It wouldn’t reflect well on anyone if Smith were fired. Resigning would be a more graceful exit, allowing him to share his findings.”

Smith is anticipated to resign from his role as special counsel in Trump’s case, given these constraints.

Joyce Vance, a vocal Trump critic, wrote on her *Civil Discourse* legal blog that Smith’s report could serve as a lasting record of Trump’s efforts to overturn the 2020 election results. Vance questioned the report’s potential value, beyond the public information and evidence already released through court filings. However, she acknowledged that it would ensure a permanent public record, especially in light of Trump’s likely attempt to have the case dismissed if he takes office in 2025.

Vance expressed frustration, stating, “It bothers me deeply that Trump has avoided accountability in front of a jury that could decide his guilt or innocence. I’ll struggle with that for a long time.”

  1. You can thank Merrick Garland's dereliction of duty and by extension, Joe Biden for the fact that Trump "has avoided accountability in front of a jury." Smith's appointment and the filing of the charges were disgracefully late, give Trump's well-known record of using pretexts to delay and undermine court cases to avoid unfavorable verdicts.

While it’s true the DoJ was stereo it in its responsibility to address the nonstop crime spree of an insurrectionist president, and the White House did not demand accountability but remained silent, it falls more on the GoP and conservative joint establishment for ignoring his first crime of impeachable bribery, then his second of impeachable election interference and inciting an overthrow of the government, and then congress, in cohorts with republican rich donors, weaponized congress , weoponized the court system, and all the conservative deep state protect a republican politician from public scrutiny! Biden or Smith can be blamed for trump’s uncanny ability to beat the system but the only way he would have succeeded was with republican enablement, which is the greatest dereliction of duty of all! How a convicted felon and traitors presidential candidate and his co-criminals could get re-elected in the “supposed” greatest democracy on the planet is not just beyond comprehension but pure idiocy! If America is an example of lawful democracy, the world is in dire straits!

It is the Supreme Court that delayed his trial by holding up a decision on his Jan 6 appeal before granting the presidency increased powers to the end of their current session that prevented the trial before the election and the Republican judge in the documents case who dismissed the case in a question able decision that is being appealed.
